He was originally detained under Immigration detention pure and simple while his claim for asylum was reviewed. When he applied for bail he was suddenly served with Notice that his detention was on the basis of national security and he was therefore subject to SIAC. When it became clear upon an appeal that it was wholly impossible to suggest that he could be safely removed to Algeria as hitherto been claimed by the Home Office, and that he would be likely to be granted bail as a result, he was then served with a certificate under the 2001 Act and is detained indefinitely without trial.
